Welcome to Hybiza Race. These Terms and Conditions govern your access and use of our website, applications and related services (hereinafter, the “Site”). By using the Site or purchasing services or registering for any of our events, you agree to be bound by these Terms. If you do not agree, do not use the Site or contract our services.

1. Scope and acceptances

These Terms incorporate by reference our Privacy Policy and other specific terms (for example, terms of purchase for registrations or store). We reserve the right to modify the Terms at any time; We will post the updated version on this page with the revision date. Continued use after changes will imply your acceptance of them.

When creating an account, you must provide complete and accurate information and keep it up to date. If you do not do so, we may suspend or terminate your account.

Your account includes a public profile where other users can see your name, state/province/country, profile photo, race photos, race statistics, and event results. Other users can follow your profile and see your achievements.

You are responsible for the security of your account and password. Do not allow others to use your account. If you suspect unauthorized use, please change your password immediately and notify us.

5. Registrations, payments and refunds

Event registrations and in-store purchases are subject to the Terms of Purchase and payment providers' policies. Cancellation and refund conditions are specified on each product/event page and in the event regulations. Check these conditions before finalizing the purchase.

You must provide a valid credit card (Visa, MasterCard or others accepted by us) for all payments. By providing your payment information, you authorize you to be billed immediately for all fees and charges due. Please notify us immediately of any changes to your billing or card address.

We reserve the right to cancel any order if we are unable to process payment or for any legal reason. In case of cancellation, we will refund prepaid fees.

There are no refunds of subscription or membership fees, except as specified in the conditions of each product.

6. Code of conduct

By participating in our events and using the Site, you agree to abide by the event's code of conduct, follow the instructions of staff, and behave safely and respectfully with other participants, sponsors, and attendees. Failure to comply may result in expulsion without the right to a refund.

7. Prohibitions

You agree not to do the following (collectively, “Prohibitions”):

Publish, upload, publish, send or transmit any content that infringes the intellectual property rights of others, is fraudulent, false, misleading, defamatory, obscene, vulgar or offensive.
Use the Site to promote discrimination, hatred, violence or illegal activities.
Access non-public areas of the Site or interfere with its operation.
Send spam, unsolicited advertising or viruses.
Collect personal information from other users without permission.
Use the Site for commercial purposes without express authorization.

If you submit photos, videos, comments or any other content ("UGC"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish and promote such material in connection with Hybiza Race. Do not submit content that infringes third party rights or is offensive; You warrant that you have the necessary rights and that all permissions are valid.

You grant us a continuous, worldwide, perpetual, irrevocable, non-exclusive, sublicensable, transferable, royalty-free license to use, copy, transmit, distribute, publicly perform, display, edit, modify and create derivative works of your UGC for any purpose.

The Site may link to other external sites. We have no control over and assume no responsibility for the content or privacy practices of third party sites. Check their terms and policies before interacting with them.

If you provide your telephone number and agree to receive notifications, you may receive informational and promotional messages in accordance with applicable regulations. Instructions for unsubscribe (for example, by sending STOP) will be detailed in the messages or on the corresponding page.

You are solely responsible for determining whether a class, course, or other use of the services available on the Site is right for you.

You understand that there are inherent risks and dangers in exercise and physical activity, and that the classes or events you may attend offer a range of activity levels and intensity. By using and participating in the Services, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns, that you are aware of these risks, including, without limitation, property damage, illness, loss and bodily injury or death. You specifically assume the risk of injury or damage.

You acknowledge and agree that it is your responsibility to consult with your physician or health care professional before using the Services for classes or races, and to determine whether and how participating in any physical activity, exercise or race is appropriate for you. DO NOT use classes or participate in races if your doctor or healthcare provider advises against it. If you experience fainting, dizziness, pain, or shortness of breath at any time while exercising or participating in physical activity, stop immediately.

You also understand and agree that the Services offer fitness and related information that is designed solely for informational, educational and entertainment purposes. Nothing stated or published on or available through any aspect of the Services is intended to be, and should not be taken as, the practice of medical, professional care or counseling. DO NOT rely on any information on or through the Services as a substitute for, nor does it replace, professional medical advice, diagnosis or treatment.
