By using the Site or contracting services or registering for any of our events, you agree to be bound by these Terms. If you do not agree, do not use the Site or contract our services.

These Terms incorporate by reference our Privacy Policy and other specific conditions (for example, purchase conditions for registrations or the shop). We reserve the right to modify the Terms at any time; we will publish the updated version on this page with the revision date. Continued use after the changes implies your acceptance of them.

2. Site Usage License

Subject to compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, and revocable license to access and use the Site for your own personal and non-commercial purposes. This license will remain in effect as long as you do not violate these Terms or until we or you terminate it. The license to use the Site is subject to the terms of any subscription or purchase you make with us.

To participate in events or use specific features, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities carried out with your account. You must notify us at info@hybizarace.es if you suspect unauthorized use.

When creating an account, you must provide complete and accurate information and keep it updated. Failure to do so may result in the suspension or termination of your account.

Your account includes a public profile where other users can view your name, state/province/country, profile picture, race photos, race statistics, and event results. Other users may follow your profile and see your achievements.

You are responsible for the security of your account and password. Do not allow others to use your account. If you suspect unauthorized use, change your password immediately and notify us.

5. Registrations, Payments, and Refunds

Event registrations and shop purchases are subject to the Purchase Conditions and the policies of payment providers. Cancellation and refund conditions are specified on each product/event page and in the event regulations. Consult these conditions before finalizing your purchase.

You must provide a valid credit card (Visa, MasterCard, or others accepted by us) for all payments. By providing your payment information, you authorize us to immediately charge you for all fees and charges owed. Notify us immediately of any changes to your billing address or card.

We reserve the right to cancel any order if we are unable to process the payment or for any legal reason. In case of cancellation, we will refund any prepaid fees.

There are no refunds for subscription or membership fees, except as specified in the conditions of each product.

6. Code of Conduct

By participating in our events and using the Site, you agree to respect the event's code of conduct, follow staff instructions, and behave in a safe and respectful manner towards other participants, sponsors, and attendees. Non-compliance may result in expulsion without the right to a refund.

7. Prohibitions

You agree not to do the following (collectively, "Prohibitions"):

Post, upload, publish, send, or transmit any content that infringes on third-party intellectual property rights, is fraudulent, false, misleading, defamatory, obscene, vulgar, or offensive.
Use the Site to promote discrimination, hatred, violence, or illegal activities.
Access non-public areas of the Site or interfere with its operation.
Send spam, unsolicited advertising, or viruses.
Collect personal information from other users without permission.
Use the Site for commercial purposes without express authorization.

If you submit photos, videos, comments, or any other content ("UGC"), you grant us a non-exclusive, worldwide, and royalty-free license to use, reproduce, adapt, publish, and promote such material in connection with Hybiza Race. Do not submit content that infringes on third-party rights or that is offensive; you warrant that you own the necessary rights and that all permissions are valid.

You grant us a continuous, worldwide, perpetual, irrevocable, non-exclusive, sublicensable, transferable, and royalty-free license to use, copy, transmit, distribute, publicly perform, display, edit, modify, and create derivative works of your UGC for any purpose.

You are solely responsible for determining whether a class, race, or other use of the services available on the Site is suitable for you.

You understand that there are inherent risks and dangers in exercise and physical activity, and that the classes or events you may attend offer a range of activity and intensity levels. By using and participating in the services, you acknowledge and agree, on your own behalf, and on behalf of your heirs, personal representatives and/or assigns, that you are aware of these risks, which include, but are not limited to, property damage, illness, loss, and bodily injury or death. You specifically assume the risk of injury or harm.

You agree and accept that it is your responsibility to consult with your doctor or healthcare professional before using the services for classes or races, and to determine if and how engaging in any physical activity, exercise, or race is appropriate for you. DO NOT use classes or participate in races if your doctor or health provider advises against it. If you experience fainting, dizziness, pain, or shortness of breath at any time while exercising or participating in physical activity, stop immediately.

You also understand and agree that the services offer fitness and related information that is designed solely for informational, educational, and entertainment purposes. Nothing stated or posted on or available through any aspect of the services is intended to be, and must not be taken as, the practice of medical, professional, or counseling care. DO NOT rely on any information in or through the services as a substitute for, or a replacement for, professional medical advice, diagnosis, or treatment. If you have any concerns or questions about your health or fitness level, you should always consult a doctor or other healthcare professional. NEVER disregard, avoid, or delay obtaining medical or health advice from your healthcare professional because of something you may have read or heard on or through the services.

THEREFORE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, INDEMNIFY AND HOLD HARMLESS US, OUR THIRD-PARTY PROVIDERS, AGENTS AND REPRESENTATIVES, EACH OF THEIR PARENTS, SUBSIDIARIES OR AFFILIATED ENTITIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, CONSULTANTS, CONTRACTED EMPLOYEES, REPRESENTATIVES AND AGENTS, AND EACH OF THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, FROM ANY AND ALL LIABILITY, CLAIMS, ACTIONS, PROCEEDINGS, COSTS, EXPENSES, DAMAGES AND LIABILITIES ARISING FROM OR IN ANY WAY RELATED TO YOUR PARTICIPATION IN ANY PHYSICAL ACTIVITY, RACES OR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO BODILY INJURY, PHYSICAL HARM, LOSS, ILLNESS, DEATH OR PROPERTY DAMAGE.

12. Limitation of Liability and Indemnities

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS US, OUR THIRD-PARTY PROVIDERS AND OUR AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS, FROM AND AGAINST ALL CLAIMS, DAMAGES, LOSSES AND COSTS ARISING FROM OR RELATED TO YOUR ACTIVITIES ON OR THROUGH OR IN CONNECTION WITH THE SERVICES, ANY CONTENT SUBMITTED BY OR ON BEHALF OF YOU OR YOUR VIOLATION OF THESE TERMS, AND WITH RESPECT TO ANY TERMS INCORPORATED HEREIN AS IN CONNECTION WITH EVENTS.

We reserve the right to modify the services, including, but not limited to, updating, adding, improving, modifying, removing, or altering any content or features of the services, at any time, at our sole discretion. You are responsible for providing your own access (e.g., computer, mobile device, internet connection, etc.) to the services. We have no obligation to screen or monitor any content and we do not guarantee that any content available on or through the services is suitable for all users or that it will continue to be available for any period of time.

YOU EXPRESSLY AGREE THAT YOUR USE OF OUR SERVICES, INCLUDING, WITHOUT LIMITATION, YOUR USE OF AND ACCESS TO YOUR USER ACCOUNT AND/OR SERVICES, IS AT YOUR SOLE RISK. TO THE EXTENT ANY DISCLAIMER OR LIMITATION OF LIABILITY DOES NOT APPLY, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL APPLICABLE EXPRESS, IMPLIED, AND STATUTORY WARRANTIES WILL BE LIMITED IN DURATION TO A PERIOD OF 30 DAYS AFTER THE DATE YOU FIRST USED THE SERVICES, AND NO WARRANTIES WILL APPLY AFTER SUCH PERIOD.
